Agreement to Terms
Welcome to myndQ.ai (“Service”), a platform operated by Ariana Digital LLC (“Company,” “we,” “our,” or “us”). These Terms of Service (“Terms”) constitute a legally binding agreement between you (“User,” “you,” or “your”) and Ariana Digital LLC governing your access to and use of the myndq.ai website, applications, and all related services.
PLEASE READ THESE TERMS CAREFULLY BEFORE USING THE SERVICE.
By accessing or using the Service, you agree to be bound by these Terms, our Privacy Policy, and any additional terms and conditions that may apply. If you do not agree to these Terms, you may not access or use the Service.

1. Eligibility
1.1 Age Requirement

1.3 Employment Eligibility
Certain features of our Service relate to employment and work authorization. By using these features, you represent that:

- You have the legal right to work in the jurisdictions you specify
- You will not misrepresent your employment eligibility status
1.4 Account Limitations
You may only maintain one active account. Creating multiple accounts is prohibited and may result in termination of all associated accounts.
2. Account Registration

To access certain features of the Service, you must create an account. You may register using:

- Phone number with SMS verification
- Google account (OAuth)
- LinkedIn account (OAuth)
- GitHub account (OAuth)
2.2 Account Information
You agree to:
- Provide accurate, current, and complete information during registration
- Maintain and promptly update your account information
- Keep your login credentials secure and confidential
- Notify us immediately of any unauthorized access to your account
- Accept responsibility for all activities that occur under your account
2.3 Password Security
You are responsible for:
- Creating a strong, unique password
- Not sharing your password with others
- Not using the same password across multiple services
- Enabling two-factor authentication when available
2.4 Account Security
We implement security measures including:
- Password hashing and encryption
- JWT token-based authentication with expiration
- Two-factor authentication (optional but recommended)
- Session management and automatic logout
However, you acknowledge that no security system is impenetrable, and we cannot guarantee the security of your account.
3. Description of Service
3.1 Overview
MyndQ is a professional development platform that provides:
- AI-powered interview practice sessions
- Resume parsing and generation
- Professional profile management
- Career assessment and feedback
- Job role recommendations
- Identity and employment verification services
3.2 Interview Practice
Our Service enables you to:
- Practice interviews with AI-powered interviewers
- Receive real-time feedback and assessments
- Review transcripts of your interview sessions
- Track your progress over time
3.3 Resume Services
Our Service provides:
- Automated resume parsing from uploaded documents
- AI-generated tailored resumes based on job descriptions
- ATS (Applicant Tracking System) optimization
- Resume assessment and recommendations
3.4 Profile Features
You can create and manage a professional profile including:
- Personal and professional information
- Education and work history
- Skills and certifications
- Professional references
- Work preferences and goals
3.5 Service Availability
While we strive to maintain high availability, we do not guarantee uninterrupted access to the Service. We may:
- Perform maintenance with or without notice
- Experience technical difficulties or outages
- Modify, suspend, or discontinue features
- Limit access during high-demand periods
4. Credit System and Payments
4.1 Credit-Based Billing
Our Service operates on a credit-based billing system:
- 1 credit = 1 minute of interview practice time
- Credits are deducted in real-time during active interview sessions
- Credits are consumed automatically as you use the Service
- Credit balance is displayed in your account dashboard
4.2 Credit Purchases
- Credits can be purchased through our platform
- All payments are processed securely through Stripe
- Prices are displayed in US Dollars (USD)
- You must have a valid payment method to purchase credits
4.3 Payment Methods
We accept:
- Major credit and debit cards (Visa, MasterCard, American Express, Discover)
- Saved payment methods for one-click purchases
By providing payment information, you represent that you are authorized to use the payment method.
4.4 Credit Deduction
- Credits are deducted at a rate of 1 credit per minute during interview sessions
- Credit deduction begins when an interview session starts
- Sessions automatically end when your credit balance reaches zero
- Partial minutes may be rounded up to the nearest whole credit
4.5 Credit Balance
- Your credit balance is displayed in real-time
- You will receive notifications when your balance is low
- You are responsible for maintaining adequate credits for your needs
4.6 Refund Policy
General Policy:
- Purchased credits are generally non-refundable
- Unused credits do not expire unless your account is terminated
Exceptions:
We may provide refunds in the following circumstances:
- Technical errors on our part that prevented service delivery
- Duplicate charges or billing errors
- Service unavailability for extended periods
To request a refund, contact support@myndq.ai within 30 days of the transaction.
4.7 Price Changes
We reserve the right to change our pricing at any time. Price changes will:
- Be announced in advance
- Not affect credits already purchased
- Take effect for future purchases only
4.8 Taxes
Prices may not include applicable taxes. You are responsible for all taxes associated with your purchases, which may be added at checkout.
4.9 Failed Payments
If a payment fails:
- Your credit purchase will not be processed
- You may retry with the same or a different payment method
- Repeated failed payments may result in account restrictions
5. Interview Sessions
5.1 Session Conduct
During interview sessions, you agree to:
- Conduct yourself professionally
- Provide truthful responses
- Not use offensive, discriminatory, or inappropriate language
- Not attempt to exploit or manipulate the AI system
5.2 Recording Consent
BY PARTICIPATING IN AN INTERVIEW SESSION, YOU CONSENT TO:
- Video recording of your session
- Audio recording of your session
- Creation of transcripts from your audio
- AI analysis of your recordings for assessment purposes
- Storage of recordings in accordance with our Privacy Policy
5.3 Technical Requirements
To use interview features, you need:
- A device with a working camera and microphone
- A stable internet connection
- A supported web browser (Chrome, Firefox, Safari, Edge)
- Permission granted for camera and microphone access
5.4 Session Termination
Interview sessions may end due to:
- Your voluntary exit
- Credit balance reaching zero
- Technical difficulties
- Violation of these Terms
5.5 Session Data
- Interview recordings are stored securely
- Transcripts are generated and stored with your account
- You may request deletion of recordings subject to our data retention policies
- AI assessments are generated automatically after sessions
6. User Content
6.1 Definition
“User Content” includes any content you submit, upload, or provide through the Service, including:
- Profile information and personal data
- Resume documents and files
- Interview responses and recordings
- Feedback and comments
- Professional references and connections
6.2 Ownership
You retain ownership of your User Content. However, by submitting User Content, you grant us a license as described below.
6.3 License Grant
By submitting User Content, you grant Ariana Digital LLC a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to:
- Use, reproduce, and store your User Content
- Process your content through AI systems
- Create derivative works (such as assessments and recommendations)
- Display portions of your content as necessary to provide the Service
This license is limited to the purposes of:
- Providing and improving the Service
- Generating assessments and recommendations
- Supporting your use of the platform
6.4 User Representations
You represent and warrant that:
- You own or have the right to submit all User Content
- Your User Content does not infringe any third-party rights
- Your User Content is accurate and truthful
- Your User Content complies with these Terms and applicable laws
6.5 Content Restrictions
You agree not to submit User Content that:
- Is false, misleading, or fraudulent
- Infringes intellectual property rights
- Contains malware, viruses, or harmful code
- Violates any law or regulation
- Is defamatory, obscene, or offensive
- Impersonates another person or entity
6.6 Content Removal
We reserve the right to remove any User Content that:
- Violates these Terms
- Is reported as inappropriate
- We deem harmful to the Service or other users
7. Artificial Intelligence Services
7.1 AI-Powered Features
Our Service uses artificial intelligence for:

- Resume generation and optimization
- Interview assessment and feedback
- Job role recommendations
- Content generation and suggestions
7.2 AI Limitations
You acknowledge and agree that:
- AI-generated content is provided for informational purposes only
- AI assessments are not definitive evaluations of your abilities
- AI recommendations do not guarantee job placement or success
- AI may occasionally produce inaccurate or incomplete results
- AI should not replace professional career counseling
7.3 Human Review
You have the right to request human review of AI-generated assessments or decisions that significantly affect you. Contact support@myndq.ai to request human review.
7.4 AI Training
By using our Service, you agree that:
- Your interactions may be used to improve our AI systems
- Aggregated and anonymized data may be used for research
- You may opt out of certain AI training uses through your privacy settings
7.5 No Professional Advice
AI-generated content does not constitute:
- Legal advice
- Financial advice
- Medical advice
- Professional career counseling
- Employment guarantees
8. Identity Verification
8.1 Verification Services
We offer identity verification through third-party services (Veriff, ID.me) to:
- Verify your identity
- Confirm employment eligibility
- Enhance account security
- Enable certain platform features
8.2 Verification Process
The verification process may include:
- Submission of government-issued identification documents
- Biometric analysis (facial recognition)
- Address verification
- Work authorization confirmation
8.3 Verification Consent
By using identity verification features, you consent to:
- Collection of identity documents and biometric data

10. Acceptable Use Policy

- Create multiple accounts
- Share account credentials
- Access others’ accounts without authorization

Technical Violations:
- Attempt to bypass security measures
- Interfere with Service operations
- Introduce malware or malicious code
- Scrape or extract data without authorization
- Use automated tools or bots (except approved integrations)
- Reverse engineer our systems
Legal Violations:
- Violate any applicable law or regulation
- Engage in fraud or deception
- Harass or discriminate against others
- Violate intellectual property rights
Commercial Violations:
- Resell or redistribute credits
- Use the Service for unauthorized commercial purposes
- Compete with our Service using our platform
10.2 Enforcement
Violations may result in:
- Warning or account suspension
- Permanent account termination
- Credit forfeiture
- Legal action
- Reporting to relevant authorities
11. Intellectual Property Rights

The Service and its contents, including but not limited to:

- Design and user interface
- Text, graphics, and logos
- AI models and algorithms
- Documentation and materials
are owned by Ariana Digital LLC or its licensors and are protected by intellectual property laws.

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for personal, non-commercial purposes in accordance with these Terms.
11.3 Restrictions

You retain ownership of your original User Content. AI-generated content (such as generated resumes and assessments) is licensed to you for your personal use.

12. Privacy and Data Protection

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ARIANA DIGITAL LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR:
- Indirect, incidental, special, consequential, or punitive damages
- Loss of profits, revenue, data, or business opportunities
- Damages resulting from unauthorized access to your account
- Damages arising from third-party services
- Damages exceeding the amount you paid us in the 12 months preceding the claim
14.2 Exceptions
Some jurisdictions do not allow certain limitations. In such cases, our liability will be limited to the maximum extent permitted by law.
14.3 Essential Purpose
These limitations apply even if we have been advised of the possibility of damages and even if any remedy fails its essential purpose.
15. Indemnification

You agree to indemnify, defend, and hold harmless Ariana Digital LLC and its officers, directors, employees, agents, affiliates, and licensors from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys’ fees) arising from:

- Your violation of any third-party rights
- Your User Content
- Your violation of any law or regulation
15.2 Indemnification Process
We reserve the right to assume exclusive defense and control of any matter subject to indemnification. You agree to cooperate with our defense of such claims.
16. Account Termination
16.1 Termination by You
You may terminate your account at any time by:
- Using the account deletion feature in settings
- Contacting support@myndq.ai
Upon termination:
- Your access to the Service will be revoked
- Your profile will be deleted according to your preferences
- Unused credits will be forfeited (unless refund exceptions apply)
- Data will be handled according to our Privacy Policy
16.2 Termination by Us
We may suspend or terminate your account:
- For violation of these Terms
- For fraudulent or illegal activity
- For extended inactivity
- For non-payment
- At our sole discretion with or without cause
16.3 Effect of Termination
Upon termination:
- Your right to access the Service ends immediately
- Any unused credits are forfeited (except as required by law)
- We may retain certain data as required by law
- Provisions that should survive termination will survive
16.4 Data After Termination
After account termination:
- You may request data export before deletion
- Data will be deleted according to retention policies
- Some data may be retained for legal compliance
- Aggregated/anonymized data may be retained indefinitely
17. Dispute Resolution
17.1 Governing Law
These Terms are governed by the laws of the Commonwealth of Pennsylvania, United States, without regard to conflict of law principles.
17.2 Informal Resolution
Before filing any formal dispute, you agree to attempt informal resolution by contacting us at legal@myndq.ai. We will attempt to resolve disputes within 30 days.
17.3 Binding Arbitration
IF WE CANNOT RESOLVE A DISPUTE INFORMALLY, YOU AND ARIANA DIGITAL LLC AGREE TO RESOLVE ANY CLAIMS THROUGH BINDING ARBITRATION.
Arbitration Rules:
- Arbitration will be conducted by JAMS under its Streamlined Arbitration Rules
- Arbitration will take place in Bucks County, Pennsylvania (or virtually, if agreed)
- The arbitrator’s decision will be binding and enforceable in any court
- You waive any right to participate in a class action lawsuit
17.4 Class Action Waiver
YOU AGREE TO RESOLVE DISPUTES ONLY ON AN INDIVIDUAL BASIS AND WAIVE THE RIGHT TO PARTICIPATE IN CLASS ACTIONS, CLASS ARBITRATIONS, OR REPRESENTATIVE ACTIONS.
17.5 Exceptions
The following disputes are exempt from arbitration:
- Small claims court matters
- Intellectual property disputes
- Injunctive relief for violations of these Terms
17.6 Opt-Out
You may opt out of arbitration by sending written notice to legal@myndq.ai within 30 days of first accepting these Terms.
18. General Provisions
18.1 Entire Agreement
These Terms, together with our Privacy Policy and any additional terms, constitute the entire agreement between you and Ariana Digital LLC regarding the Service.
18.2 Severability
If any provision of these Terms is held invalid or unenforceable, the remaining provisions will continue in full force and effect.
18.3 Waiver
Our failure to enforce any right or provision of these Terms will not constitute a waiver of such right or provision.
18.4 Assignment
You may not assign or transfer these Terms without our prior written consent. We may assign these Terms without restriction.
18.5 No Agency
Nothing in these Terms creates an agency, partnership, or joint venture between you and Ariana Digital LLC.
18.6 Third-Party Beneficiaries
These Terms do not create any third-party beneficiary rights, except as expressly provided.
18.7 Notices
We may provide notices to you through:
- Email to your registered address
- In-app notifications
- Posting on the Service
You may provide notices to us at legal@myndq.ai.
18.8 Force Majeure
We are not liable for any failure or delay due to circumstances beyond our reasonable control, including natural disasters, war, terrorism, labor disputes, government actions, or internet failures.
18.9 Headings
Section headings are for convenience only and do not affect interpretation of these Terms.
19. Changes to Terms
19.1 Modifications
We may modify these Terms at any time. We will notify you of material changes by:
- Updating the “Last Updated” date
- Posting a notice on the Service
- Sending an email notification
19.2 Acceptance of Changes
Your continued use of the Service after changes are posted constitutes acceptance of the modified Terms. If you do not agree to the changes, you must stop using the Service.

- Real-time video interview capabilities
- AI-powered interview assistants and interviewers
- Interview transcription and recording services
- AI-driven candidate evaluation and assessment
- Resume parsing and job matching
- Interview practice and preparation tools
- HR management and applicant tracking features
2.2 AI Interview Features
Our Platform utilizes artificial intelligence to:
- Conduct interviews through voice-enabled AI assistants
- Transcribe conversations in real-time
- Analyze and evaluate interview responses
- Generate assessment reports and recommendations
2.3 User Types
- Candidates: Job seekers participating in interviews
- Interviewers: Human interviewers conducting or observing interviews
- HR Administrators: Organizational users managing hiring processes
- Observers: Users with view-only access to interviews
3. Eligibility
3.1 Age Requirements
You must be at least 16 years of age to use the Service. By using the Service, you represent and warrant that you are at least 16 years old.
3.2 Authority
If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.
3.3 Restrictions
You may not use the Service if:
- You have been previously banned or suspended from the Platform
- You are prohibited from receiving services under applicable laws
- You do not agree to these Terms
4. Account Registration and Security
4.1 Account Creation
To access certain features, you must create an account by providing accurate, complete, and current information.
4.2 Account Security
You are responsible for:
- Maintaining the confidentiality of your account credentials
- All activities that occur under your account
- Notifying us immediately of any unauthorized access
- Using strong passwords and enabling additional security features when available
4.3 Account Accuracy
You agree to:
- Provide truthful and accurate information
- Update your information to keep it current
- Not impersonate any person or entity
- Not create multiple accounts for improper purposes
5. Acceptable Use Policy
5.1 Permitted Uses
- Participate in legitimate job interviews
- Conduct interviews for lawful employment purposes
- Practice and prepare for interviews
- Manage hiring processes within your organization
5.2 Prohibited Conduct
You agree NOT to:
Fraudulent Activity:
- Provide false or misleading information in your profile or resume
- Impersonate another person or entity
- Misrepresent your qualifications or experience
- Submit falsified documents or credentials
Harmful Behavior:
- Harass, threaten, or abuse other users
- Use offensive, discriminatory, or inappropriate language
- Engage in any form of discrimination based on protected characteristics
- Attempt to manipulate or deceive AI systems
Security Violations:
- Attempt to gain unauthorized access to the Platform
- Interfere with or disrupt the Service

6. Consent for Recording and AI Processing
Recording Consent
BY PARTICIPATING IN INTERVIEWS ON OUR PLATFORM, YOU CONSENT TO: Audio recording of your voice during sessions, video recording of your image during sessions, storage of recordings for review and evaluation, and sharing of recordings with authorized employers and interviewers.
AI Processing Consent
YOU ACKNOWLEDGE AND CONSENT TO: Your voice being processed by AI voice recognition systems, your responses being analyzed by AI algorithms, AI-generated evaluations and assessments of your performance, automated transcription of your spoken words, and AI-powered matching of your qualifications to job requirements.
6.1 Disclosure of AI Interaction
We will clearly indicate when you are interacting with an AI interviewer. The AI may operate in different modes:
- Main Interviewer: AI conducts the entire interview
- Co-Interviewer: AI assists human interviewers
- Assistant: AI responds only when specifically addressed
6.2 Withdrawal of Consent
You may withdraw consent by declining to participate in recorded interviews, requesting deletion of your recorded data, or closing your account. Note: Withdrawal of consent may limit your ability to use certain Platform features.
7. Intellectual Property
7.1 Platform Ownership
The Service, including all content, features, functionality, software, and trademarks, is owned by Ariana Digital LLC and protected by intellectual property laws.
7.2 User Content Ownership
You retain ownership of content you submit to the Platform, including:
- Resume and profile information
- Interview responses
- Uploaded documents
7.3 License to User Content
By submitting content to the Platform, you grant us a non-exclusive, worldwide, royalty-free license to:
- Store and process your content
- Share your content with employers as intended
- Use your content to improve our AI systems (in anonymized/aggregated form)
- Display your content within the Platform
7.4 AI-Generated Content
Content generated by our AI systems (including evaluations, summaries, and recommendations) is owned by Ariana Digital LLC and may be shared with employers for hiring decisions.
8. Credits, Fees, and Payment
8.1 Credit System
The Platform operates on a credit-based system where:
- Credits are required to access certain features (e.g., practice interviews)
- Credits are consumed based on usage (e.g., interview minutes)
- Credit balances are displayed in your account
8.2 Payment Terms
- Credit packages and pricing are displayed on our Platform
- Payment is due at the time of purchase
- Prices are subject to change with reasonable notice
- All fees are quoted in US dollars unless otherwise specified
8.3 Refunds
- Unused credits may be eligible for refund within 30 days of purchase
- Used credits are non-refundable

- Refunds are processed within 5-10 business days
8.4 Promotional Credits

- OpenAI: AI processing and voice technology
- Supabase: Data storage and authentication
- Vercel: Application hosting
- Google Cloud: Speech processing
9.2 Third-Party Availability
We are not responsible for outages or failures of third-party services, changes to third-party service functionality, or third-party service terms or privacy practices.
10. Employer Terms (HR Administrators)
10.1 Company Registration
HR Administrators registering their organization must:
- Have authority to act on behalf of the organization
- Provide accurate company information including EIN
- Comply with all applicable employment laws
10.2 Hiring Practices
Employers using our Platform agree to:
- Use candidate data only for legitimate hiring purposes
- Comply with equal employment opportunity laws
- Not discriminate based on protected characteristics
- Make final hiring decisions through human review
10.3 AI Evaluation Disclaimer
Employers acknowledge that AI evaluations are advisory tools, not determinative. Human judgment should be applied to all hiring decisions. AI systems may have limitations. Employers are responsible for their hiring decisions.
11. Disclaimers
SERVICE “AS IS”
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY.
11.1 No Warranty
WE DISCLAIM ALL WARRANTIES INCLUDING:
- MERCHANTABILITY
- FITNESS FOR A PARTICULAR PURPOSE
- NON-INFRINGEMENT
- ACCURACY OR COMPLETENESS OF CONTENT
- UNINTERRUPTED OR ERROR-FREE SERVICE
11.2 AI Limitations
WE DO NOT WARRANT THAT:
- AI evaluations are accurate or unbiased
- AI recommendations will result in successful hiring
- AI transcriptions are error-free
- AI systems will function without errors
11.3 Employment Outcomes
WE DO NOT GUARANTEE any particular employment outcome, job placement or hiring, interview success, or accuracy of job matching.
12. Limitation of Liability
EXCLUSION OF DAMAGES
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ARIANA DIGITAL LLC SHALL NOT BE LIABLE FOR: Indirect, incidental, special, consequential, or punitive damages; loss of profits, data, use, or goodwill; damages arising from reliance on AI evaluations; damages caused by third-party services; unauthorized access to your account; any damages exceeding the amount you paid us in the 12 months preceding the claim.
The limitations in this section reflect the allocation of risk between you and Ariana Digital LLC and are a fundamental element of the basis of the bargain. Some jurisdictions do not allow certain limitations; in such cases, our liability is limited to the maximum extent permitted by law.
13. Indemnification
You agree to defend, indemnify, and hold harmless Ariana Digital LLC and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including attorneys’ fees) arising from:
- Your use of the Service
- Your violation of these Terms
- Your violation of any rights of another party
- Content you submit to the Platform
- Your hiring decisions (for employers)
14. Dispute Resolution
14.1 Informal Resolution
Before filing any formal claim, you agree to contact us at talenthub@myndQ.ai to attempt to resolve the dispute informally.
14.2 Arbitration Agreement
Any dispute not resolved informally shall be resolved by binding arbitration under the rules of the American Arbitration Association. The arbitration will be conducted in Pennsylvania, USA.
14.3 Class Action Waiver
YOU AGREE TO RESOLVE DISPUTES WITH US ON AN INDIVIDUAL BASIS AND WAIVE ANY RIGHT TO PARTICIPATE IN CLASS ACTIONS OR CLASS ARBITRATIONS.

These Terms are governed by the laws of the Commonwealth of Pennsylvania, USA, without regard to conflict of law principles.

You may terminate your account at any time by:

- For fraudulent or illegal activity

Upon termination, your right to access the Service ceases immediately, we may delete your data according to our retention policy, unused credits are forfeited (unless eligible for refund), and provisions that should survive termination will survive.
